These Terms & Conditions govern all transactions between Prime Field Agric Limited and international buyers, ensuring clear understanding, compliance, and protection for both parties.
1. Agreement to Terms
By placing an order with Prime Field Agric Limited, buyers agree to be bound by these Terms & Conditions. Any modifications must be agreed upon in writing.
2. Orders and Confirmation
- All orders must be submitted with detailed product specifications, quantity, and destination.
- Order confirmation will be provided via email, including pricing, Incoterms, and delivery schedule.
- Prime Field Agric Limited reserves the right to refuse orders that cannot meet compliance or quality standards.
3. Pricing and Payment
- Pricing is based on product type, quantity, and destination logistics.
- Payment methods include international bank transfer and other agreed arrangements.
- Advance payment or agreed trade terms are required before shipment.
4. Shipment and Delivery
Products are shipped according to agreed Incoterms (FOB, CIF, CFR, etc.). Delivery timelines are estimates and subject to regulatory inspections, carrier schedules, and unforeseen events.
5. Packaging and Quality Assurance
All products are packaged for safe transit and inspected for quality. Buyers must notify Prime Field Agric Limited of any product concerns within 7 days of receipt.
6. Import Compliance
Buyers are responsible for ensuring compliance with all import regulations, customs duties, and taxes applicable in the destination country (EU, Middle East, or US).
7. Liability
Prime Field Agric Limited is not liable for damages resulting from improper storage, handling, or customs delays once products have been shipped according to agreed terms.
8. Force Majeure
Neither party is liable for failure or delay caused by events beyond reasonable control, including natural disasters, strikes, regulatory actions, or logistics disruptions.
9. Intellectual Property
All content, branding, and materials provided by Prime Field Agric Limited remain the property of the company and may not be used without written consent.
10. Governing Law
These Terms & Conditions are governed by the laws applicable in Kenya, and any disputes shall be resolved under Kenyan jurisdiction unless otherwise agreed in writing.
